Exceptions to Warrants

Introduction

There are numerous exceptions to the warrant requirement - situations where even absent a warrant, it is lawful and permissible for law enforcement to perform searches and/or seizures of property. These exceptions include, although are not limited to, seven categories:

1) Searches incident to arrest;
2) Searches under exigent circumstances;
3) Automobile searches;
4) Container searches;
5) Searches conducted in furtherance of an inventory;
6) Searches with consent; and
7) Searches of objects in plain view.
