Introduction

If an individual provides a confession, he may, depending on the situation, challenge the confession on several grounds, including violation of his due proves rights under the Fourteenth amendment, violation of his Fifth Amendment rights, or violation of his Sixth Amendment right to counsel. This chapter will address the Fourteenth Amendment, which prevents states from depriving any person of "life, liberty, or property, without due process of law," as well as the Fifth Amendment, which provides that no person shall be "compelled in any criminal case to be a witness against himself."
